New Partner C. Scott Toomey Joins Littleton Joyce
Littleton Joyce is pleased to announce that C. Scott Toomey has joined us as the Managing Partner of our new Philadelphia office. For almost two decades, Scott has successfully defended companies faced with personal injury, death and property damage lawsuits. He has tried major cases and argued appeals in Pennsylvania, New Jersey and, as product line defense counsel, throughout the United States. Scott also serves as a Member of the Board of Directors of the Pennsylvania Defense Institute and Co-Chair of its Products Liability Committee. He is active in the Defense Research Institute and the Philadelphia Association of Defense Counsel and has published and lectured extensively to legal and industry groups.

Littleton Joyce Defense Verdict Reported in Los Angeles Top Verdicts of 2010
Following a six-week trial in the Los Angeles County Superior Court, Robert J. Kelly, along with local counsel, Yukevich, Calfo & Cavanaugh obtained a defense verdict for our helmet manufacturing client. The high stakes case involved a seventeen-year old motor cross rider, who suffered a severe and permanent brain injury as a result of a crash. The plaintiffs’ demand entering trial was over $15 million. At trial, the plaintiffs contented that the helmet worn by the rider was defective and should have prevented the brain injury. We argued that the helmet performed as required and prevented any direct injury. The rider’s brain injury could not have been prevented by the helmet, as this type of injury could not have occurred from impact. All defendants with the exception of our client settled prior to trial. After 10 hours of deliberations, the jury returned a defense verdict finding that the subject helmet was not defective and the manufacturer did not fail to warn plaintiff.

Rebecca Ulisse Becomes a Partner in the New York City Office
Littleton Joyce is pleased to announce that Rebecca Ulisse has become a partner in the firm. Rebecca practices litigation in multiple areas of law, with an emphasis on product liability. Her work encompasses defending domestic and international manufacturers against claims of defect, breach of warranty, violation of general business laws and various commercial issues on a local and national basis.

Summary Judgment Granted in Texas Motorcycle Helmet Product Liability Case
Jim Ughetta and David Prichard of the Prichard Hawkins McFarland & Young firm achieved a dismissal of a helmet manufacturer in a case venued in the United States District Court for the Western District of Texas, Del Rio Division. The 21 year old ATV rider sustained fatal injuries when his ATV struck a parked trailer.

Wendy Shepps Secures Dismissal of Legal Malpractice Action Pre-Answer
In an alleged fraudulent real estate conveyance matter, Wendy Shepps secured dismissal of an action against our client. It was alleged that our client was the attorney representative for the lender at the real estate closing. Based on documentary evidence, we were able to secure dismissal of the action against our client before engaging in any discovery.
